It is our policy that visitors to our Site who are under the age of 18 should not post on or provide any information to this Site without the consent of their parents. This Site is not designed for or intended for use by persons under the age of 18.

5. Text Message Policy

By providing your cell phone number, you have provided KCS with consent to send you account notifications including reminders and updates regarding your account via text.

A technology called “cookies” may be used to collect certain computer or internet information.

KCS does not respond to do not track signals.

7. California Residents – California Consumer Privacy Act (CCPA):

Although we believe that based upon the types of services we provide KCS may be exempt from certain features of California’s Consumer Privacy Act (CCPA), we provide you with general information about the CCPA.

Under the California Consumer Privacy Act (CCPA), California residents may have the right to request through a verifiable consumer request, that a business disclose certain information. Once we receive and confirm your verifiable consumer request, we may disclose:

The categories of personal information that it has collected about that consumer.

The categories of sources from which the personal information is collected.

The business or commercial purpose for collecting or selling personal information.

The categories of third parties with whom the business shares personal information.

The specific pieces of personal information it has collected about that consumer.

8. Information We May Collect About You

We typically collects and discloses the following categories of personal information from consumers within the preceding 12 months:

Personal information does not include: Publicly available information from government records; Deidentified or aggregated consumer information; Information excluded from the CCPA’s scope, such as:

Health or medical information covered by the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”) and the California Confidentiality of Medical Information Act (“CMIA”) or clinical trial data; personal information covered by the Fair Credit Reporting Act (“FCRA”), the Gramm-Leach-Bliley Act (“GLBA”) or California Financial Information Privacy Act (“FIPA”), and the Driver’s Privacy Protection Act of 1994.

We collect most of this personal information from our clients or from you or your authorized representative by telephone or by electronic or other written communications. We may also collect information from our service providers, from third parties and from third parties with your consent;

We will retain this personal information so long as reasonably required in accordance with our data retention policies and procedures and is required by applicable law.

A California resident has the right to request through a verifiable consumer request that we delete personal information, subject to certain exceptions. If the information we maintain about you falls into one or more exceptions, we may not be able to delete the information. 

A California resident has the right to request through a verifiable consumer request that we correct inaccurate personal information, subject to certain exceptions and the nature of the personal information.

To exercise your rights please provide your full name, address, date of birth, account number if applicable, and the last four numbers of your Social Security number by Emailing us at customerservice@kcs-arm.com or calling us at 1-800-366-0950. Please note that you may only make a request twice within a 12-month period.

We do not sell personal information to third parties.

A consumer has a right not to receive discriminatory treatment by us for the exercise of the privacy rights conferred by the California Consumer Privacy Act.

A consumer can designate an authorized agent to make a request under the California Consumer Privacy Act by sending us a notarized power of attorney or notarized written authorization.

9. Changes to This Privacy Policy

We may revise this Privacy Policy from time to time. Modifications go into immediate effect after they have been posted. See the last updated date at the end of this Privacy Policy. If you do not agree with the policy, you should cease use of the site immediately.
